# AI tool age limits: what your child can actually use

We teach AI to 13-18 year-olds, so we had to know which tools a 13-year-old is actually allowed to open an account on. We read the terms of 124 of them. 59 passed. This is the whole list, including the ones we threw out, with the vendor's own words next to each.

## Why so many AI tools ban children

Most parents assume an AI tool bans under-13s because it is unsuitable. That is usually not the reason. Age floors in software terms track **contract law and data-protection liability** — COPPA in the US, GDPR Article 8 in Europe, and India's DPDP Act 2023 — not whether the tool is any good for a child. A minor cannot form a binding contract, so the safest thing a vendor can write is a high number.

That cuts both ways. Some genuinely careful tools ban under-16s for paperwork reasons. And some tools that look harmless bar under-18s while a tool with real adult content sits at 13. **You cannot tell from the marketing. You have to read the terms.** So we did.

Two things worth knowing before you scan the list. A tool saying “13, or the minimum age required in your country” quietly means **18 in India**, because that is the age you can consent for yourself here. And parental consent does not always help: a few vendors say in writing that the adult must *be* the account holder, or that consent cannot cure the bar at all.

Usable at 13

No barrier for a 13-year-old in any market we teach in.

Needs parent consent

A 13-year-old may use it once a parent or guardian consents. The student stays the account holder.

14+ only

A clean floor of 14. Our 14-18 students may use it; our 13-year-olds may not.

16+ only

A clean floor of 16. Our 16-18 students may use it; our 13-15s may not.

## Chat and writing AI

### ChatGPT

Needs parent consent

**Minimum age:** 13; parental permission required 13-17. Self-escalates to the local consent age, and OpenAI publishes no country table.

The cleanest text tool audited. The guardian must accept the terms BEFORE first use - an onboarding step, not a bar.

### Microsoft Copilot

Needs parent consent

**Minimum age:** 13 in UK/US/UAE. 18 in India, Saudi Arabia, Qatar, Germany, France, Italy. 16 in Portugal/Malta/Slovenia. 14 in Spain/Austria.

Microsoft is one of the few vendors that publishes a per-country table. India = 18 is Microsoft's own figure, and it independently corroborates the DPDP reading.

### Claude (Anthropic)

Not taught: age

**Minimum age:** 18 everywhere, or higher where local law requires.

"Whichever is higher" means there is no downward relief, and the consumer terms offer no parental-consent route. Bars the entire 13-18 cohort.

### Google Gemini

Not taught: age

**Minimum age:** 13 general; 16 in Germany, Ireland, Netherlands, Poland and others; 15 in France; 14 in Spain, Italy, Austria.

The Family Link exclusion is decisive. In the EU-16 states a 13-year-old cannot manage their own account, and the parent-supervised account is explicitly blocked from Gemini. There is no compliant route, so consent cannot cure it.

Not taught: age

The vendor admits its bots may produce content unsuitable for minors in the same clause that permits 13-year-olds, with no gate between the two. Poe aggregates third-party bots and disclaims responsibility for them.

Best content posture of the image tools: the NSFW filter is a DEFAULT, not an opt-in. The vendor concedes it is not rigid and suggests adding your own moderation layer.

### Stable Diffusion

Not taught: age

**Minimum age:** 18 everywhere, or higher.

The policy binds the MODEL, not just the website - self-hosting does not escape it. DreamStudio, the front-end most tutorials point at, now redirects to an unrelated company.

### Craiyon

NSFW is uploader-tagged and viewer-opt-in, not a default classifier - so untagged adult content is visible to everyone by construction. The vendor's own rules contemplate content "whether or not" it is tagged.

### Artbreeder

The terms contain no content policy, no NSFW clause and no likeness policy at all, on a face-breeding tool, and were last updated in 2019. Separately, every image a student makes is released to the public domain, and that survives deleting the account.

Worse than its terms suggest: explicit models are reachable while logged out with no age gate, and the not-for-all-audiences tag is uploader opt-in rather than a default.

## Learning and research

### Wolfram Alpha

Needs parent consent

**Minimum age:** Under-18 permitted with permission from a parent, guardian OR TEACHER. No account needed to query.

The cleanest consent mechanic found anywhere in this audit, and the only vendor that names a TEACHER as a valid consenting adult, which fits a taught course exactly. The minor remains the user.

### Duolingo Max

Usable at 13

**Minimum age:** Under-13s permitted as restricted Child Users, in every region.

Duolingo sidesteps consent by collecting no personal data. Its Terms have no age clause at all; the floor lives only in the incorporated Privacy Policy. Max is a paid subscription a minor cannot contract for, so a parent must purchase.

### Khan Academy Khanmigo

**Minimum age:** 13, or the local consent age; under-13s permitted via parent or school.

### iNaturalist

**Minimum age:** 13 to make an account, exactly our floor, so zero margin. The EU/UK uplift could not be verified because the site is Cloudflare-walled.

Its own guidance warns observations are "public records of where someone was at a certain time and place", so a student posting from home publishes a timestamped location trail. Use obscured geoprivacy, and prefer Seek for 13-15s.

Its plain-English column says "have your legal guardian sign up for you", which makes the GUARDIAN the account holder, so the student is not a permitted user and consent cures nothing. Note codepen.io/legal returns HTTP 200 while serving a user profile.

**Minimum age:** "An adult". The only carve-out is written for under-13s.

A drafting gap that lands exactly on this cohort: a 13-17 year old is neither "an adult" nor "younger than 13", so is not clearly permitted. No education product exists to escape to. Separately, public Apps are auto-MIT-licensed and feed LLM training, which a 13-year-old cannot validly grant.

The vendor publishes no Terms of Service at all, and the 13 rests on a privacy policy rewritten two days before this audit. If the syllabus meant the ChatGPT plugin, OpenAI's terms govern instead.
